On October 31st, the National Labor Relations Board (NLRB) – don’t worry, no bad news to follow – released some memos clearing up the surprising confusion surrounding the National Labor Relations Act (NLRA) and at-will employment policies.
The guidance was not issued simply at-will (see what I did there?), but instead after much review of cases heard last summer – cases that suggested at-will employment agreements may violate the NLRA.
The bottom line from the memos: to keep your at-will employment policy in line with the NLRA, it cannot require your employees to waive any rights.
