On January 29, Congresswoman Rosa DeLauro and Senator Chris Dodd called for Congress to act on the Paycheck Fairness Act. This proposed Act would amend the Equal Pay Act (EPA) to:
- prohibit retaliation against employees for sharing salary information
- allow prevailing plaintiffs to recover damages in EPA cases
- facilitate class action lawsuits under the EPA.
For employers, this means it would be easier for a disgruntled employee to bring a claim against an employer. Because this is not law, no action is needed at this time. However, it does remind us of the importance of establishing a pay structure this is applied fairly, regardless of sex, age, nationality, race, or any other protected status.
